Main requirements for surrogacy in Greece

According to the Greek legislation the following set of guidelines can be considered appropriate when considering going forward with a surrogate mother in Greece.

  • The applicant mother must be up to 50 years old. This is deemed to be the maximum reproductive age of women according to Greek Law.
  • The applicant mother must have a medical condition prohibiting her from getting pregnant, which needs to be proven medically.
  • The surrogate must be between 25 and 45 years old, have at least one child, have less than two caesarean sections and be both physically and mentally fit. These also need to be proven medically.
  • The applicant mother, her spouse and the surrogate must undergo medical examinations for HIV-1, HIV-2, HEP B-C and Syphilis, a simple blood exam that can be arranged upon your visit in the clinic of your choice.
  • Either the applicant mother or the surrogate must have residency, or temporary residency, in Greece.
    It is mandatory, according to Greek law, that the genetic material to be transferred to the surrogate must not be biologically connected to her, the fertilized eggs cannot belong to her.
  • A written agreement regarding the surrogacy needs to be signed by all parties involved and is submitted to the Court. If either or both the applicant female and the surrogate are married or have a cohabitee the Surrogacy agreement needs to be signed by them also.
  • Payment of the surrogate’s services or any other kind of financial benefit is against the law save compensation of necessary medical treatements.
  • Once all the necessary documents are available, our office will file an application with the Court and get a hearing date. The involved parties do not required to be present at the hearing date since our firm can fully represent them. This though (presence or not) will be decided in relation to the particulars of each case.
  • Once the application is accepted, the court issues a leave to proceed with the surrogate procedures.

Please Note:
If the applicant is a single person or a non-married couple The written agreement regarding the surrogacy needs to be signed before a Greek Notary Public in the presence of an English- speaking interpreter, this takes place in Greece. A document of paramount importance in a single woman application is the document of family status or any equivalent document proving the single status of the female applicant.

NECESSARY DOCUMENTS

  • Copies of passports of all parties involved (applicant mother, surrogate and their spouses/partners if applicable).
  • Marriage certificate (with Apostille/or any other authentication) of the applicant mother and her spouce/partner, if applicable.
  • Medical document(s) proving the applicant’s medical inability to give birth.
  • Marriage certificate (with Apostille/or any other authentication) of the surrogate & herspouce/partner, if applicable.
  • Birth certificate(s) of the surrogate’s child/children.
  • Medical documents proving the surrogate is physically and mentally able.
  • Certificate of family status for both parties
  • Certificate of residency
